Terms of Service

These Terms of Service (“Terms”) govern your use of bookcondosdirect.com (the “Site”), operated by BookCondosDirect. By using the Site you agree to these Terms.

What the Site is

BookCondosDirect is a listing platform. Vacation-condo owners publish listings, and guests book directly with the owner through the owner’s own booking system. BookCondosDirect is not a party to any booking, charges guests no booking fees and owners no commissions, and does not process payments. The contract for any stay is between the guest and the owner, on the terms (including cancellation and refund policies) presented in the owner’s booking system.

Owner accounts

Owner registration is currently by invitation. You are responsible for your account credentials and for all activity under your account. You must provide accurate information and keep it current.

Owner responsibilities

By publishing a listing you represent that you own the property or are authorized to offer it for rent; that your listing (including photos and pricing) is accurate; and that renting the property complies with applicable law, including licensing, tax, and short-term-rental regulations for its location. You are solely responsible for honoring confirmed bookings and for your dealings with guests.

Listing content

You retain ownership of the content you submit. You grant BookCondosDirect a non-exclusive, royalty-free license to host, display, and promote that content on and in connection with the Site. You must have the rights to all content you submit. We may remove content or suspend accounts that violate these Terms, mislead guests, or create risk for the platform or its users.

Acceptable use

You may not use the Site to post false or infringing content, interfere with the Site’s operation, attempt unauthorized access, or scrape or republish Site content in bulk.

Disclaimers

The Site is provided “as is” and “as available.” We do not inspect properties and make no warranties about any listing, property, owner, or guest, nor that the Site will be uninterrupted or error-free. Booking availability and pricing shown in owners’ booking widgets come from the owners’ own systems.

Limitation of liability

To the fullest extent permitted by law, BookCondosDirect is not liable for indirect, incidental, special, or consequential damages, or for any dispute between guests and owners, arising out of or relating to the Site or any stay. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination (content license for published periods, disclaimers, limitation of liability) survive.

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date; continued use of the Site after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law rules.
